Terms of sale and services
1. Purpose
Professionnalisable is a digital platform published and operated by Exceptions SAS. These terms govern the sale of the platform's paid services.
They supplement the terms of use. By ordering a paid service, you accept them.
2. Services and prices
The services below are those actually offered, at the prices in effect on the day this page is displayed.
| Service | Price | Billing | Renewal invoice |
|---|---|---|---|
|
Professionnalisable Site
First month free, once per account.
|
2 USD | per month | 10 days before |
| Professional Domain | 60 USD | per year | 60 days before |
| Additional professional email account | 10 USD | per year | 60 days before |
The professional domain plan includes the domain name, its technical configuration, a security certificate and one professional mailbox. Additional mailboxes are billed separately, at the price shown above.
The price applicable to an order is the one displayed at the time of that order. It is then frozen on the invoice: a later change of price never alters an invoice already issued.
3. Currency and tax
Prices are expressed in United States dollars (USD) and are the prices due.
Exceptions SAS does not apply value added tax to these services as its situation currently stands. No tax is therefore added to the displayed amount, and invoices contain none.
Should that situation change, invoices and these terms would be updated, and a new version published.
4. First month free
The website plan includes a free first month, counted from the publication of the website.
The trial is granted ONCE PER ACCOUNT, not once per website: creating a second website does not reopen a new free month.
No payment method is required to benefit from it, and the trial does not turn into an automatic charge: at its end an invoice is issued, and it is your payment that continues the service.
If you pay before the trial ends, the paid period starts on the day of payment: you do not lose the remaining trial days, they are simply closed by your payment.
5. Ordering
An order is placed from your account area. It covers an identified service, for an identified website, at the price displayed at the time of the order.
A website can only be covered by ONE main plan at a time: the monthly website plan or the annual domain plan. Subscribing to the annual plan replaces the current monthly plan, with no refund of the month started, which you keep the benefit of.
6. Payment
Payments are made by mobile money, through a secure payment gateway. Your payment details are entered at that gateway: we keep none of that data.
Payment is deemed complete when the gateway confirms receipt to us. YOUR BROWSER RETURNING DOES NOT CONSTITUTE PAYMENT: confirmation reaches us through a separate channel, and it is that confirmation which triggers activation. A payment may therefore take a few moments to be taken into account.
In the event of failure or abandonment, no sum is due and the service is not activated.
7. Service activation
Activation takes place as soon as receipt is confirmed, with the following nuances.
THE WEBSITE SUBSCRIPTION is active immediately, for the period paid.
THE PROFESSIONAL DOMAIN enters a processing queue: paid does not mean reachable. Its registration, the name server configuration and the certificate issue require operations that are not instantaneous, and DNS record propagation can take up to forty-eight hours. The website continues to be served at its professionnalisable.com address in the meantime.
THE MAILBOX is reserved as soon as payment is made, then created with the provider. Until it is created, it appears as being set up: the address does not yet receive mail.
THE GUIDANCE SESSION enters technician matching as soon as payment is made.
8. Term and renewal
The website subscription is monthly; the professional domain and additional mailboxes are annual.
Services continue from one period to the next through the settlement of the renewal invoice. THERE IS NO AUTOMATIC DEBIT: each period is paid by a deliberate act on your part.
The renewal invoice is issued before the due date, with a lead time specific to each service, shown in the services table. Reminders are sent to you before the due date.
Not paying therefore amounts to not renewing: there is no need to terminate.
9. Invoicing
Each service gives rise to a numbered invoice, viewable and printable from your account area.
The invoice freezes the detail of what was invoiced: description, unit price, quantity, amount, currency and period covered. A later change in prices never alters an invoice already issued.
Invoices are kept and remain accessible from your account area.
10. Late or missing payment
After the due date, the invoice remains payable. A seven-day tolerance period runs before any consequence for the service: it allows a payment in progress to complete.
At the end of that period, the service concerned is closed:
- the website subscription having lapsed, the website stops being accessible to the public
- the professional domain stops being operational, and the website is again served at its professionnalisable.com address
- the mailboxes concerned are suspended.
No data is deleted at that stage, and no replacement invoice is issued.
11. Going offline and reinstatement
Going offline for non-payment is reversible and involves no loss.
Your content, your public address, your images and your invoices are kept. Your website remains viewable and editable from your account area: only its distribution to the public is interrupted. Visitors receive a neutral page, which does not state the reason — your payment situation is no business of your clients.
Settling the invoice automatically restores accessibility, in the exact state in which you left the website: a published site becomes public again, a draft stays a draft.
This is DISTINCT from a moderation suspension. A website suspended on moderation grounds stays down even after payment: payment never lifts a moderation decision. See the terms of use.
12. Professional domain
The professional domain plan includes the registration of a domain name, its technical configuration, a security certificate and a first professional mailbox.
THE DOMAIN NAME IS REGISTERED IN YOUR NAME. It belongs to you. Its registration depends on an outside registrar and on the rules specific to the chosen extension: the availability of a name cannot be guaranteed before it is actually reserved.
Activating the domain on our servers is subject to technical checks: the DNS records must point to our infrastructure and must actually have propagated. Those delays are not within our control.
On expiry without renewal, the domain stops being operational and your website is again served at its professionnalisable.com address, which stays attached to you. Returning to the base plan is an explicit choice on your part: we do not re-subscribe you automatically.
13. Professional mailboxes
The domain plan includes one professional mailbox. Additional mailboxes may be ordered, at the annual price shown in the services table.
Certain technical addresses are reserved for operating the domain and cannot be assigned.
WE KEEP NO MAILBOX PASSWORD and have no access to the content of your messages. Backing up your mail is your responsibility.
On expiry, the mailbox is suspended: its content is not deleted by the suspension itself, but its retention depends on the email provider's terms. Do not wait for the due date to back up what matters.
14. Guidance sessions
Guidance is an optional service: a session with a technician working within the Professionnalisable scheme, remotely or on site, to help you build and publish your website.
The price, duration and conditions of the session are frozen at the time of the order: a later price revision does not change a request already registered.
The process is as follows:
- you have 24 hours to pay for the request, failing which it expires
- we look for a technician for 48 hours; if none is found, the session cannot take place and you are refunded
- the session takes place at the confirmed slot
- you confirm that it went well; absent any response from you within 3 days, it is treated as validated
- you have 7 days after the session to report a problem.
YOU REMAIN IN CONTROL OF YOUR ACCOUNT. A technician assists you; they do not act in your place, never have any reason to know your password, and may receive no payment outside the platform.
15. Cancelling a session
You may cancel a session from your account area.
Cancelled more than 24 hours before the appointment, the session is refunded.
Cancelled less than 24 hours before the appointment, it gives rise to a credit note usable on a later session, not to a refund: the slot was reserved and the technician made themselves available.
If you do not attend the appointment without having cancelled, the session is treated as due.
16. Refunds
We would rather state plainly what is refunded and what is not.
ARE REFUNDED: a guidance session for which no technician could be assigned within the set period; a session cancelled within the time limits; and any sum collected in error on our part.
ARE NOT REFUNDED, absent express agreement: the current subscription period, which you keep the benefit of until its end; the registered domain name, which was acquired in your name from a third party; the mailbox created; and the guidance session delivered.
A refund request is addressed to our support team, which examines it and answers you with reasons. Refunds are processed manually and follow the route of the original payment method.
17. Services depending on third parties
Domain name registration, hosting, professional email and payment collection rely on outside suppliers.
We select those suppliers carefully and follow up operations, but we control neither their lead times, nor their interruptions, nor their own terms. A delay or unavailability on their part cannot be attributed to us, and gives rise to no compensation beyond what is set out in the following section.
18. Respective responsibilities
WE UNDERTAKE to provide the services ordered, to keep you informed of their state, to issue accurate invoices and to warn you before any due date.
YOU UNDERTAKE to pay the sums due, to keep your contact details up to date and to comply with the terms of use, in particular as to the content you publish.
Our liability in respect of paid services is capped at the sums you have actually paid us for the service concerned during the twelve months preceding the triggering event. It does not extend to indirect damage, in particular loss of turnover or of clientele.
THESE LIMITATIONS DO NOT APPLY in cases of gross negligence or wilful misconduct, nor where the law does not allow liability to be limited.
19. Changes to services and prices
Prices may change. A new price never applies to a period already invoiced: it takes effect from the following renewal period, and you are informed of it before the corresponding invoice is issued.
You remain free not to renew.
20. Governing law and disputes
These terms are governed by the law of the République Démocratique du Congo.
In case of difficulty, contact our support team first. Failing an amicable agreement, the dispute falls to the competent courts of the République Démocratique du Congo, without prejudice to any mandatory provisions you may benefit from where you reside.
